General Information
A natural person who is the holder of an Irish TM, Community TM, or a UK TM (where the registered TM holder is situated within the 32 counties; the island of Ireland) or the licensed user of a trademark, may be eligible for this category.

A pending trademark may be accepted where documented evidence from a recognised patent attorney or the Patents Office is provided stating that sufficient progress has been made, or time elapsed, that in the view of the patent attorney or Patents Office the trademark application will be successful, or where the trademark application and filing receipt are provided along with a letter from the applicant.

TM holders will be able to apply for multiple connotations of the TM name. The proposed domain name will still have to correspond closely with the TM, but may include plurals, descriptors, or non descriptive elements such as numbers or letters and may also differ in respect of signs, symbols or punctuation.

Where the name(s) applied for are, in the opinion of the Registry, likely to cause confusion or be offensive, the Registry retains the right to refuse such an application.

If an Irish applicant is the licensed user of a trademark they may add their name, or a reasonably close element, to the requested domain name, with permission from the trademark holder.

Required [Faxed] Documentation
A copy of the trademark certificate. If the trademark certificate does not show who the trademark owner is then the applicant must provide a signed letter on headed paper from the Patents Office or a firm of Irish trademark attorneys clearly stating the name of the trademark owner.

A copy of the applicant's passport, birth certificate or citizenship certificate (this will verify the applicant's legal name)

Where the applicant is a licensed user of the trademark, the applicant must provide a signed letter on headed paper from the trademark owner authorising the applicant to register and hold the corresponding .IE domain.

Where the application is made on the basis of a pending TM application the Registry will require a copy of the TM application form and official filing receipt, along with a letter from the TM holder.

The applicant for registration of the above mentioned domain name is the proprietor of a pending Irish/UK TM(where the registered trademark holder is situated within the 32 counties of Ireland; the island of Ireland) or CTM application for the mark _______. A copy of the TM application and official filing receipt are enclosed. The applicant acknowledges the right of the IE Domain Registry Ltd to deactivate or delete the domain name should the pending TM, which is the basis for registration, be withdrawn, abandoned or refused or should it be successfully challenged by a third party.
